Initially, the investigators ruled out El Chicle because he did not pass by in the same time zone. His phone could be positioned via repeater in that area, but not with GPS data because, when handed over to the Guardia Civil, the device had been formatted “consciously” hours before. The studies also concluded that El Chicle approached Diana Quer at the intersection between Paseo del Arenal and Venecia street, since the GPS positionings of Diana’s cell phone mark in this area the location of the young woman that morning. Despite the errors in the positionings, of some meters, “where José Enrique Abuín says he approached her it is impossible” that she was, commented an investigator of the case during the trial, given that “there are almost 200 meters of distance”.

A forensic report concluded that the body had been floating for at least 20 days, since “fly pupae”, a non-aquatic species that needs oxygen to survive, were detected in the victim’s hair. The testimony contradicts the version given by El Chicle because it shows that the corpse had to be counterweighted a second time. For their part, the forensic teams that have intervened in the trial have disagreed with the existence of physical evidence that Diana suffered a sexual assault, although they have agreed that the young woman died strangled with a bridle and not, as the accused claims, by having exerted excessive pressure with her hands. In this sense, the poor state of preservation in which the corpse was found must be taken into account, since it had been submerged for nearly 500 days.

En la madrugada del 25 de diciembre de 2017, El Chicle intentó invitar a varias jóvenes a subir a su coche en la cercana localidad de Boiro. Intentó meter a una en el maletero de su coche a punta de cuchillo, pero sus gritos llamaron la atención[6] Durante su interrogatorio, confesó haber matado a Quer; la ató y la metió en su coche a la fuerza y la estranguló. Reveló la ubicación del cuerpo, en un pozo de un almacén abandonado en Rianxo, a 20 kilómetros del lugar del crimen y a sólo 200 metros de su propia casa[7].

Algunos autores consideraron que el caso tuvo una cobertura desproporcionada al ser Quer joven, adinerada y mujer (ver Síndrome de la mujer blanca desaparecida)[12][13] Un caso contrastado con el de Quer fue el de Iván Durán, un hombre de 30 años de la cercana Baiona, que desapareció tres días después. El padre de Durán dijo que los recursos policiales se destinaron de forma desproporcionada a la búsqueda de Quer[14] La autopsia indicó que Durán se suicidó con un arma de fuego poco después de salir de su casa[15].

The father of Diana Quer, Juan Carlos Quer, has valued this Saturday the verdict issued by the popular jury that has declared José Enrique Abuín Gey guilty of kidnapping, murder and sexual assault: “My daughter smiles from heaven today”.  In statements to the press after learning of the jury’s decision, Juan Carlos Quer considered that the verdict has led to the sentence of permanent revisable prison, which in any case must be determined by the judge, and which in his opinion will make it possible that “this individual will never again attempt against the life and sexual freedom of a woman”.

Diana Quer’s phone was disconnected shortly before three in the morning. The Guardia Civil’s cell phone experts reconstructed that moment.  It remained to locate the exact place and there appeared a key witness: a girl who was returning home that night and saw Diana walking in front of her, a few minutes before her disappearance.  A surveillance camera had recorded a flash of headlights entering the highway at the time of the abduction. The next step was to identify the model of that car. At that moment, José Enrique Abuín became a suspect.

The Supreme Court confirms the sentence of permanent reviewable imprisonment to the perpetrator of the murder of Diana Quer. It affirms that the sentence fits the gravity and perversity of the act and the serious attack on a woman as the one the accused deployed. The sentence highlights the “atrocious suffering” of the victim and rejects that the media interest of the case contaminated the jury.

Juan Carlos Quer, father of Diana Quer, has valued the verdict of the popular jury against José Enrique Abuín Gey, the ‘Chicle’, for which he has been found guilty of the abduction, sexual assault and murder of his daughter in 2016, however the jury exempts him from rape because it could not be proven. “My daughter is smiling from heaven today,” commented Juan Carlos Quer.

The jury in charge of deciding the degree of guilt of José Enrique Abuín Gey, the ‘Chicle’, in the crime of Diana Quer has unanimously found him guilty of abduction, murder and “acts of sexual content that could not be determined”, but they have not been able to prove that there was rape, which would have opened the door to his being sentenced to permanent revisable prison.
